1. How We Collect Information

(1) When you register a Waky Pro account, we may collect basic personal information including your nickname, age, avatar, gender, email, or mobile number. After logging in, you can choose to add more information on your profile page, such as birthday, zodiac sign, relationship status, hometown, educational background, occupation, and personal tags, to showcase your personalized profile. Additionally, new Waky Pro users can log in via third-party platform accounts (e.g., Google, Facebook). For more information, please refer to Section 1.3 below.

(2) When you publish any User Generated Content ("UGC") within Waky Pro, such as your musical works, singing creations, or status updates (including any content in audio, video, image, text, or other formats), we may need to collect your published UGC, publication time, location information, singing records, playlists, etc., based on the specific features you use.

(3) We may use the contact information you provide (e.g., email address) to conduct user surveys or send you information about products and services you might find interesting. Where required by applicable laws and regulations, we will seek your consent before sending marketing communications. If you are not interested in such information, you can opt-out at any time, for example, by sending an unsubscribe request, and we will respect your choice.

1.2 Personal Information Provided or Generated When You Use Waky Pro

(1) Any user can browse publicly available UGC within Waky Pro; you can access this content upon registering an account or logging in. We may collect your browsing history to help you track and further explore content you have viewed.

(2) To enhance your social networking experience and increase exposure of your published UGC, you can find friends within the APP to build connections in the Waky Pro community. Simultaneously, we may recommend users you might be interested in through data analysis to help you interact with others and fully enjoy Waky Pro.

(3) When you use the instant messaging chat function, we may collect your chat history. Rest assured, your data will be encrypted. We only process chat data for security purposes, such as automatically filtering inappropriate content involving pornography, violence, or fraud. We always value your privacy and security.

(4) When you use our recharge or payment functions (e.g., VIP services) and initiate payment requests, we collect necessary information including your User ID, country/region, payment currency, payment amount, payment time, payment method, and order number. This information helps us complete the payment and transaction process smoothly through the application programming interface (API) of third-party payment service providers. We ensure the security of your payment information.

(5) When you use the feedback function within Waky Pro, we need to collect your feedback description and screenshots. Without this information, we may be unable to help resolve your issue or respond to your feedback. Additionally, if you wish to report something (e.g., illegal content, user behavior, or infringement of your rights), we need to collect your report description, report type, and relevant chat records (if applicable) to understand the facts and assist you.

(6) To improve your experience (e.g., facilitating account information viewing, receiving push notifications, and providing personalized content/services), we may automatically collect information related to your system settings, including language, operating system, network information (e.g., IP address), device data (e.g., IMEI and other device identifiers), country/region, geographical location, SIM card country code, network operator name and number, device model, screen resolution, and anonymous user identifiers. We analyze this data to provide you with better services.

(7) To maintain the stability and security of Waky Pro and your account, when you use Waky Pro, we automatically collect data related to the mobile application's operation and your online activities, such as login status, click and operation data, user device data (e.g., IMEI and other device identifiers), operating system data, and network information (e.g., IP address).

1.3 Personal Information Provided by Third Parties

For your convenience in using the Waky Pro application, you can choose to register and log in to Waky Pro using your account on a third-party platform (e.g., Google, Facebook). In these cases, we may collect your nickname, avatar, third-party account information and Open ID, birthday/age, gender, friend list, location, etc. Logging in via these third-party accounts signifies your consent for the third party to provide us with relevant personal information.

If you provide any personal information concerning individuals other than yourself, please ensure you inform the relevant data subjects about the contents of this Privacy Policy. You confirm that before providing this personal information, you have obtained their consent or satisfied other legal bases. By submitting this information, you represent that you are authorized to provide the relevant data and agree to our processing of this information for the purposes stated in this Privacy Policy. If you do not accept these Cookies, you may not be able to use all features of Waky Pro.

3. How We Share Information

To provide you with better services, we may engage third parties (e.g., cloud service providers assisting us in providing Waky Pro related services) to process your personal information on our behalf. We enter into strict confidentiality agreements with these third parties, requiring them to process personal information according to our instructions, this Privacy Policy, and the confidentiality and security measures required by applicable laws and regulations. We may share your personal information with third parties in the following circumstances:

(1) To allow you to register for Waky Pro using your social network account details (e.g., Facebook, Google), you will provide us with, or allow your social network to provide us with, your phone number, email address, username, and public profile. We similarly share certain information with the relevant social network, such as your device data (e.g., device identifiers) and network information.

(2) We provide information and content to service providers supporting our business, such as cloud service providers, analytics service providers (to ensure Waky Pro is a safe and enjoyable place), and service providers assisting our marketing platforms. We may use Google Analytics to collect and share information about our service usage, such as frequency of user visits, activities performed within the service, and location when logged in, to calculate royalties, implement marketing campaigns, and provide customized services for users in specific regions. This is necessary for our collaboration with music licensors to provide users with high-quality music services.

(3) We may also share your information with other members of our corporate group, subsidiaries, or affiliates to provide, improve, and optimize Waky Pro's services, prevent illegal use, and support users.

(4) If we use user-generated content and video content from the platform as part of advertising and marketing campaigns to promote the platform, your personal data contained in such information may be disclosed to recipients of these advertisements or marketing content.

(5) In the event of any change, merger, acquisition, reorganization, or liquidation involving the transfer of personal information, we will require the new company or organization handling your personal information to continue processing it according to this Privacy Policy. If the new company or organization needs to use your personal information for purposes not stated herein, it will seek your consent, unless otherwise stipulated by applicable laws and regulations.

Please note: If your personal profile is public, your content will be visible to anyone on Waky Pro. Your friends, followers, and third parties like search engines, content aggregators, and news websites may also access or share your content. Each time you upload a video, you can choose who can view it, or you can set your work to "Visible Only to Me."

4. How We Protect Information

To create a privacy-friendly environment, Waky Pro offers various privacy protection features to help you control the personal data visible to other users. For example, you can set your works to "Visible Only to Me" to hide your UGC; if you are a VIP user, you can also withdraw your viewing history after viewing other users' content or spaces. Additionally, you can choose to receive or decline specific types of notifications (e.g., comments, gifts, family notifications). We employ appropriate technical and organizational measures to protect the collection and processing of your personal information, ensuring the security level matches potential risks.

Please note that while we implement various security measures, absolute security on the internet cannot be guaranteed. If you discover a leak of your personal information, please contact us immediately using the contact information provided under "How to Contact Us" so we can take appropriate action. In the event of accidental, force majeure, or other circumstances leading to a personal information leak, we will make every effort to control the situation and promptly explain the cause, the measures we've taken, and the security measures you can take. If a security incident related to personal information occurs, we will report it to the relevant authorities as required by laws and regulations and conduct timely investigation and emergency response.

5. How We Store Information

A. Cross-Border Transfers

We have local servers in multiple countries globally. Due to the needs of global operations and security management, your personal information may be transmitted to and processed in other jurisdictions where our affiliated companies are located. In such cases, we will take necessary and appropriate protective measures to ensure the security of your personal information during transmission and require the recipients of your personal information to provide adequate protection and security safeguards in accordance with this Privacy Policy and applicable laws and regulations.

B. Retention Period

For personal information you provide and generate when using Waky Pro (e.g., chat information) and personal information provided to us by third parties (e.g., third-party platform account information, payment information), you can access it within the corresponding features of Waky Pro.

(2) Correct Your Personal Data

We will take reasonable steps to ensure your personal information is accurate and up-to-date. If your personal information is inaccurate or incomplete, you have the right to request its correction. For personal information you voluntarily provided, such as nickname, avatar, birthday, personal tags, etc., you can correct it within your Waky Pro profile (Settings page). For personal information you provided and generated when using Waky Pro (e.g., chat messages) and personal information provided to us by third parties (e.g., third-party platform account information, payment information), if you believe such information needs correction, you can contact us via the APP. Please note that for personal information provided by third parties, we cannot keep it updated; you need to contact the third party directly for corrections.

(3) Delete Your Personal Data

You have the right to request that we delete your personal information. If you wish to do this, please contact us via the APP.

(4) Right to Lodge a Complaint

You have the right to lodge a complaint with a data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority. Before lodging a complaint, we hope you will first contact us to share your concerns. We will endeavor to address your questions and protect your rights.

(5) Right to Withdraw Consent

If we process your personal data based on your consent, you can withdraw that consent at any time. Please note that withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal, nor does it affect the lawfulness of processing we conduct based on other lawful grounds.

7. Minor Protection Terms

If you are the parent or legal guardian of a minor, please carefully read this Privacy Policy and be responsible for your child's activities before allowing them to create a Waky Pro account and use the application. We recommend you closely monitor your child's usage on Waky Pro and ensure they only use features appropriate for their age.

We fully recognize the special responsibility to protect minors when collecting and processing personal information. We strongly advise parents and guardians to educate children not to disclose or provide any personal information without your prior consent. If we discover that a minor's personal information has been collected without the permission of a parent or legal guardian, we will delete such information as soon as possible. 8. CHILDREN'S PRIVACY

We are committed to providing a safe, respectful and inclusive environment for all users, especially children and young people. We do not tolerate any form of child sexual abuse, exploitation or endangerment of child safety. We strictly abide by relevant laws and regulations and take all necessary measures to protect children from harm.

(1). Zero Tolerance Policy

We firmly oppose any form of child sexual abuse and exploitation. Any attempt to use our platform for such activities will be immediately banned and reported to the relevant law enforcement agencies.

(2). Prohibited Content and Behavior

The following behaviors are strictly prohibited on our platform: Sharing, disseminating or soliciting child sexual abuse material (CSAM). Seducing, harassing or exploiting children sexually. Glorifying or promoting child sexual abuse in any form. Creating or disseminating content or links related to child sexual abuse.

(3). User Responsibilities

All users must abide by the following rules: Do not upload, share or disseminate any content involving child sexual abuse. Do not interact or communicate inappropriately with minors. If you find any suspicious behavior or content, you must report it to the platform immediately and we will handle it expeditiously.

(4). Reporting Mechanism

We encourage users to actively report any suspicious behavior or content. Reporting methods include: Submit a report through the in-app reporting function. Send an email to jomanali221@gmail.com. All reports will be strictly confidential and handled by a professional team in a timely manner.

(5). Law enforcement cooperation

We work closely with global law enforcement agencies, child protection organizations and industry partners to actively combat child sexual abuse and exploitation. If we find any illegal behavior, we will immediately report it to the relevant law enforcement agencies and provide necessary assistance.

(6). Technology and manual review

We use advanced technical means (such as artificial intelligence and image recognition) combined with manual review to proactively detect and remove content related to child sexual abuse. At the same time, we continue to improve our review mechanism to respond to changing threats.

(7). Education and prevention

We are committed to raising public awareness of child sexual abuse and supporting prevention efforts through the following ways: Provide users with educational resources related to child safety. Work with child protection organizations to carry out publicity activities. Provide tools for parents and guardians to help them keep children safe online.

11. Applicable Law and Dispute Resolution

(1) This Agreement is entered into and signed by you and the Waky Pro team in Hong Kong; the formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the jurisdiction where the agreement is signed (excluding conflict of laws principles).

(2) Preliminary Dispute Resolution. Both parties agree that if any dispute, disagreement, or claim (collectively referred to as a "Dispute") arises regarding the use of the services or any matter related thereto, including but not limited to disputes concerning the validity, enforceability, or other aspects of the terms and conditions, the parties shall first seek resolution through friendly negotiation. (3) If a resolution cannot be reached through the above method within thirty (30) days after one party issues written notice, either party shall have the right to submit the Dispute to the Hong Kong International Arbitration Centre ("HKIAC") for arbitration, to be conducted in accordance with the arbitration rules and procedures in effect at that time. The arbitration shall take place in Hong Kong, governed by Hong Kong law, with the language of arbitration being Chinese. The arbitral tribunal shall consist of one or three arbitrators, the specific number to be agreed upon by the parties. If the parties cannot reach an agreement, the arbitrator(s) shall be appointed by HKIAC. The arbitral award shall be final and binding on both parties. Except as otherwise provided herein, the arbitration fees shall be borne by the losing party. If the arbitral tribunal determines that one party has partially prevailed and the other party has partially prevailed, the arbitration fees shall be allocated proportionally by the arbitral tribunal based on the circumstances. Furthermore, you understand the borderless nature of the international internet and agree to comply with all local laws and regulations regarding online conduct and content. Specifically, you agree to comply with all applicable laws and regulations concerning the transmission of information exported from your country or region.
